GENERAL

  1. Wonderwins India Private Limited (“ITP/we/us”) recognizes the value of the personal information and sensitive personal information of its users (“User/you/your”). This Privacy Policy (“Policy”) is effective [insert] and governs the collection and processing of the information you share with us while you use our website/mobile application (“Platform”).
  2. By using our Platform, interacting with us, submitting information to us or signing up for any promotions or services offered by us, you agree and consent to our, as well as our respective representatives collecting, receiving, processing, storing, transmitting and sharing amongst themselves your personal data, and disclosing such personal data to ITP’s authorized service providers and relevant third parties in the manner set forth in this Policy. If you disagree with this Policy, we recommend you not to use or access our Platform or the services we offer.
  3. This Policy does not apply to any website(s), mobile sites and mobile apps of third parties, even if our websites/products are linked to our Platform. Please take note that information and privacy practices of ITP’s business partners, advertisers, sponsors or other sites to which ITP provides hyperlink(s), may be different from this Policy. It is recommended that you review the privacy policies of any such third parties with whom we interact.
  4. This Policy is an integral part of your Terms (hyperlink) with ITP and all capitalized terms used, but not otherwise defined herein, shall have the respective meanings as ascribed to them in the Terms. In the event of any conflict, inconsistency or conflict between this Policy and the Terms, the terms specified in this Policy shall prevail specifically in relation to the matters stated herein.

Type of Information we collect and its Legal Basis

  1. Information you provide. We shall ask you to provide only such personal including sensitive personal information which is required for lawful purposes in connection with your use of the Platform and our services and necessary to be collected by us for such purpose, such information shall include:
    1. Your contact details and identity such name, gender, date of birth, mobile number, State of residence, postal address, email address; and
    2. Your financial such as credit or debit card details, bank account number, IFSC code, etc.
    During the course of your use of the Platform we may also request you to provide additional sensitive personal information in order to verify your identity. We do not use your personal information (including sensitive personal information) other than to administer the services.
  2. Information we collect.
    1. Usage Information. In addition to any personal information or other information that you choose to submit to us, we and our third-party providers may use a variety of technologies that automatically (or passively) collect certain information whenever you visit or interact with the Platform (“Usage Information”). This Usage Information may include the browser that you are using, the Uniform Resource Locator (“URL”) that referred you to our services, the internet protocol address, browser type, browser language, date and time of your request, search terms and may include a domain name and the date and time for each page you view. We also collect the name of and information about any advertisement or other link that brought you to us. This information does not personally identify you. We use IP addresses to diagnose problems with our servers and to administer our Platform.
    2. Geo location. Your IP address is also used by us to gather broad demographic information, such as your general geographic location and internet service provider. IP addresses are further used to help determine the number of our Users to maintain efficient administration of our services, to optimize user experience and to help us analyze aggregate usage behavior.
    3. Device Information. In addition, we collect for your computer, mobile or other device used to access the Services (“Device”) the corresponding IP address or other unique identifier for the Device (“Device Identifier”). A Device Identifier is a number that is automatically assigned to your Device used to access the services, and our computers identify your Device by its Device Identifier.
    4. Third party websites. If you access our games or services through other platforms, or our Platform leads you to third-party websites, such as ESPNCricinfo, their privacy practices may differ from those of ITP. ITP has no control over the policies, actions or omissions of third-party websites and is not responsible or liable for any such policies, acts or omissions. If you submit personal information to any of those websites, your information is governed by the applicable third-party privacy policies and not by this Policy. We urge you to carefully review the policy of any website you link to, visit or share information with prior to doing so.
    5. Email, feedback and comments. If you email us, we may store copies of such email or similar communications between you and us. This can result in the collection of your email address or other personally identifiable information you may have in your email text, addresses, or other fields, as well as the collection of your IP address, the internet or other routing of your communication, and the date and time of your communication. All transmissions between you and us, including emails, URLs, cookie identification numbers, usage paths, and any personally identifiable information they might contain, pass through many third party machines, operating systems, programs, browsers, web servers, networks, routers, ethernet switches, Internet Service Providers, proxy servers, intranets, the public telephone systems, or other devices, any of which may create activity logs containing such transmissions, and many of which we cannot control. When you send email, feedback, comments or other communication to us, we may retain those communications in order to process your inquiries, respond to your requests, improve our services, and may post or use such communications without any obligation to you.
    6. Cookies. Usage Information may be collected using a cookie. If you do not want information to be collected through the use of cookies, your browser allows you to deny or accept the use of cookies. Cookies can be disabled or controlled by setting a preference within your web browser or on your Device. If you choose to disable cookies or flash cookies on your Device, some features of the services we offer may not function properly or may not be able to customize the delivery of information to you. ITP cannot control the use of cookies (or the resulting information) by third parties and use of third-party cookies is not covered by our Policy.
  3. Information shared by third parties.
    1. Referrals. If you are invited to the Platform by another User, the person who invited you can submit personal information about you such as your email address, your social media handle or other contact information.
    2. Third – party services. If you link, connect, or login to the Platform with a third party service (such as Google, Facebook), you direct the service to send us information such as your registration, friends list, and profile information as controlled by that service or as authorized by you via your privacy settings at that service.
      On a need-to-know basis, we may, from time to time, collect such relevant information about you as may be necessary from other third parties. We may combine the information you submit under your account with information from such third parties in order to provide you with a better experience and to improve the quality of our services.
  4. Information collected by mobile applications.
    1. If you are using our mobile application, we may collect and use technical data and related information, including but not limited to, technical information about your Device, system and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support and other services to you (if any) related to such mobile applications.
    2. The mobile application may automatically collect and store some or all of the following information from your mobile device (“Mobile Device Information”), in addition to the Device Information, including without limitation: (i) Your preferred language and location, (ii) the manufacturer and model of your mobile device; (iii) your mobile operating system, (iv) the type of mobile internet browsers you are using, (v) your geolocation, (vi) information about how you interact with the mobile application and any of our websites to which the mobile application links, such as how many times you use a specific part of the mobile application over a given time period, the amount of time you spend using the mobile application, how often you use the mobile application, actions you take in the mobile application and how you engage with the mobile application, (vii) information to allow us to personalize the services and content available through the mobile application.
    3. On the installation of the mobile application, a list of permissions appears and are needed for the application to function effectively, these permissions include access to your SMS, contacts, location, identity, device and caller ID, Wi –fi information, photo, media or file gallery, notifications.

How we use and disclose the information we collect

We will use your personal information only as permitted by law, and subject to the terms of our Policy and as set forth below:

  1. To facilitate your use of the Platform. We may use the information you provide as permissible under the law and for the purposes set forth below:
    1. to verify your identify
    2. to provide the services we offer, including our games
    3. to personalize your use of services
    4. to process transactions and billing, for identification and authentication purposes
    5. to communicate with you concerning transactions, security, privacy, and administrative issues relating to your use of the services
    6. to improve our services
    7. to respond to your enquiries
    8. to tell you of services that we think may be of interest to you
    9. to comply with applicable law
    10. to enforce our policies
    11. to resolve disputes with other members
    12. to enforce agreements with third parties
    13. for the administration of and troubleshooting regarding the services we offer. Third parties who provide technical support for the operation of the services (our web hosting service, for example), may need to access such information from time to time, but are not permitted to disclose such information to others; and
    14. we may also display your personal information on your account or profile page or elsewhere according to your preferences
  2. To display on your public profile. You may make certain information publicly visible to others which would include your profile picture, first name, description, and city to other Users. We may display parts of your public profile and other content you make available to the public like listing details on third-party sites, platforms and applications. Information you share publicly on the Platform may be indexed through third-party search engines. In some cases, you may opt-out of this feature in your account settings. We shall not publicly display any sensitive personal information provided by you to us.
  3. To share information with third parties. While operating our business, it may be necessary or appropriate for us to provide access to your personal data to others such as our service providers, contractors, select vendors and affiliates so that we can operate the services and our business. Where practical, we will seek to obtain confidentiality agreements consistent with this Policy and that shall limit others’ use or disclosure of the personal data you have shared.
  4. To enforce our legal obligations. We may also share your personal data if we are required to do so by law or we in good faith believe that such action is necessary to: (i) comply with the law or with legal process (such as pursuant to court order, or instructions by governmental authority, or a request by law enforcement officials); (ii) to protect, enforce, and defend our Terms, rights and property; (iii) protect against the misuse or unauthorized use of the services; or (iv) protect the personal safety or property of our Users or the public (among other things, this means that if you provide false information or attempt to pose as someone else, information about you may be disclosed as part of any investigation into your actions).
  5. To carry out advertising and marketing. We may use the information you share with us to send you promotional messages, marketing, advertising, and other information based on your preferences and social media advertising through social media platforms, personalize, measure, and improve our advertising, administer referral programs, rewards, surveys, contests, or other promotional activities or events sponsored or managed by ITP or its third-party partners, analyze characteristics and preferences to send you promotional messages, marketing, advertising and other information that we think might be of interest to you, and invite you to events and relevant opportunities.

    We may also disclose or share non-personal or anonymous or aggregated information with third parties, such as usage statistics of our services or IP addresses. Aggregated non-personally identifiable information is information recorded about Users and collected into groups so that it no longer reflects or references an individually identifiable user. These third parties may collect information when users visit our services. These third parties may use this aggregated information about your visits to this and other websites in order to provide advertisements on the other websites and other forms of media about goods and services of interest to you.
  6. Business transfers. In the event ITP undertakes or becomes involved in a merger, acquisition, reorganization, any form of sale of some or all of our assets, bankruptcy, or insolvency event, then we will provide notice if such a transaction results in your information being subject to a different policy.
  7. Companies in the group. In order to improve personalization and service efficiency, we may, under secure circumstances, share your personal information with our affiliate or associate entities. This will enable us to provide you with information about various products and services or help us address your questions and requests in relation to our services.

Security

  1. The security and confidentiality of your personal data is extremely important to us. We have implemented technical, administrative and physical security measures to protect user information from unauthorized access and improper use. From time to time, we review our security procedures in order to consider appropriate new technology and methods. Please be aware though that, despite our best efforts, no security measures are perfect and impenetrable, and no data transmissions over the web can be completely secure. Consequently, we cannot ensure or warrant the security of any information you transmit to us and do so at your own risk.
  2. If we collect information from your computer, we encrypt it while it’s being transferred to us. Once the information reaches our secure servers, as part of our security program, we employ standard procedures and safeguards, such as maintaining firewalls and having an intrusion detection system, to protect the confidentiality, security and integrity of the information we maintain.
  3. However, as with any information travelling over the internet and kept in servers, we cannot guarantee absolute security. When we work with third parties, we require that they maintain the confidentiality, security and integrity of the information and commit that the information is not used for any prohibited purpose. Additionally, we use commercially reasonable computer security safeguards to protect our databases and servers against risks of loss, unauthorized access, destruction, misuse, modification, or inadvertent or improper disclosure of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data. We restrict access to personal information to our employees, contractors and agents who need to know that information in order for us to provide, develop or improve our services. Security risks, however, cannot be completely eliminated and we therefore cannot guarantee complete security. If you send us an email, you should know that email is not necessarily secured against interception. Therefore, if your communication will include sensitive information such as your bank account, Aadhar Card, PAN Card and you prefer not to transmit it electronically, please contact us by postal mail or telephone rather than email. We do not send emails asking for a User's username and password or its windows username and password or any other username or password.

Withdrawal, Access and Correction of your Personal Data

  1. You may withdraw or request us to modify and correct your personal data provided directly to us in connection with the services, by writing to us at support@wonderwins.com .
  2. Please note that if your personal data has been provided to us by a third party, you must contact such party directly to make queries, feedback, and access and correction requests to ITP on your behalf.
  3. Please note that if you withdraw your consent to any or all use of your personal data, depending on the nature of your request, ITP may not be in a position to continue to provide its services to you or administer any contractual relationship in place.

Changes to the Policy

ITP at its sole discretion may modify this Policy at any time. If we do so, we will post the revised Policy and update the “Last Updated” date at the top of this Policy. You are requested to keep yourself updated with the Policy from time to time. Your continued usage of the Platform would be deemed to be an acceptance of the modifications of the Policy.

Governing Law and Jurisdiction

This Policy shall be governed in all respects by the laws of India. To the fullest extent permitted by applicable laws, you hereby expressly agree that any proceeding arising out of or relating to this Policy shall be instituted in courts in New Delhi, India.
